General Terms and Conditions (GTC) – Urlaub auf Krk d.o.o.

1. Introduction

Urlaub auf Krk d.o.o. is not the owner of the holiday accommodations offered on the platform. It operates as an online advertising portal that provides owners with a platform to present their properties for rent. The services of Urlaub auf Krk d.o.o. include the technical provision of the platform, advertising, and the software-supported processing of bookings on behalf of the respective owners. Urlaub auf Krk d.o.o. acts exclusively as a technical service provider to bring guests and owners together; the rental agreement is concluded directly between the guest and the respective property owner.

2. Booking

A booking becomes valid from the moment the booking confirmation is issued. The person booking must be at least 18 years old. For the booking to remain valid, a deposit must be paid (see Section 3). For "bookings on request," guests will receive payment instructions for a direct transfer to the owner. The dates will be blocked in the calendar for a period of 48 hours. The guest must send proof of payment to [email protected]. If payment is not received within 48 hours, the dates will be released for other bookings without any further obligation to the guest.

3. Prices and Payments

All prices are stated in Euro (€). The rental price includes all utility costs (water, electricity, internet, waste disposal), final cleaning, bed linen, towels, and the maintenance of the swimming pool, garden, and the unit. Payment is made directly to the owner via bank transfer or credit card in two installments:

  • Standard Deposit: Usually 30% of the total price to confirm the booking.
  • Villa Ohana: For bookings of "Villa Ohana," a deposit of 50% of the total price is required.
  • Balance Payment: The remaining 70% (or 50% for Villa Ohana) must be paid at least 30 days before arrival.
  • Last-Minute Bookings: For bookings made within 30 days of arrival, the full amount (100%) is due immediately. If payments are not made within the specified deadlines, the contract may be terminated and the booking cancelled without a refund of any amounts paid.

4. Cancellation and Changes

In the event of a cancellation by the guest, the following conditions apply:

  • Up to 30 days before arrival: Refund of 100% of the booking amount, minus a handling fee of 50€.
  • 30 to 14 days before arrival: Refund of 50% of the booking amount.
  • Less than 14 days before arrival / No-show: 0% refund (100% of the total amount is charged). Requests for booking changes are not binding for Urlaub auf Krk d.o.o. or the owner. If a change request cannot be met, the standard cancellation terms remain in effect.

5. Arrival and Departure (Check-in / Check-out)

Check-in takes place after 4:00 PM, and check-out must be completed by 10:00 AM. Earlier arrivals or later departures require express prior consent. Failure to comply with the check-out time entitles the owner/agent to charge the security deposit as well as an additional night at a special rate. If the guest does not arrive on the scheduled date, the property remains reserved for 24 hours. Without notification of a delay, the property will be released for other bookings, and the guest will have no claim to a refund.

6. Guest Registration

Prior to arrival, the guest must complete an online check-in to be registered in the official Croatian tourist information system (eVisitor). Access to the accommodation may be denied to any guest who refuses to complete the online check-in. The link for the check-in portal will be sent via email no later than 10 days before arrival.

7. Accommodation

Descriptions, photos, and locations are intended to be as accurate as possible, though minor deviations may occur. The property is to be used exclusively for holiday purposes. The number of persons must not exceed the maximum capacity stated in the offer (including children of all ages). If the property is occupied by more than the permitted number of persons, the owner/Urlaub auf Krk d.o.o. is entitled to ask the additional persons to leave or terminate the contract immediately (eviction within 2 hours, no refund).

  • Youth Groups: Guests under the age of 25 are considered a youth group and must declare this at the time of booking.
  • Tents/Caravans: Pitching tents or parking caravans on the property is strictly prohibited and leads to immediate termination.
  • Pets: Allowed only in designated properties for a fee of 50€ per pet/stay. Pets are strictly prohibited from entering the pool (Violation fine: 300€ cleaning fee).
  • Swimming Pool: Use is at your own risk. For extraordinary maintenance or cleaning due to improper use, a fixed service fee of 350€ will be charged. Pool heating is available for 20€/day.
  • Smoking: Prohibited inside all units. Violations will result in the forfeiture of the security deposit.
  • Internet/Noise: No liability is accepted for external noise (construction, neighbors) or fluctuations in internet speed/coverage.

8. Security Deposit and Damages

The guest is required to transfer a security deposit before arrival. This deposit serves as security for the owner for any damage to the property. If no damage is found, the deposit is returned after departure. A handover protocol will be signed by both parties during check-in and check-out. If damage exceeds the deposit amount, the guest is liable for the full cost of repair.

9. House Rules and Conduct

Guests must adhere to the house rules displayed in the property. Serious violations or behavior that endangers the property entitle the owner/Urlaub auf Krk d.o.o. to terminate the rental agreement immediately without refund (eviction within 2 hours).

10. Complaints and Defects

If the guest notices any defects (e.g., cleaning, maintenance), they must report them immediately to the owner/host and allow a reasonable period for rectification. The owner is solely responsible for the condition and equipment of the accommodation.

11. Urlaub auf Krk d.o.o. as an Advertising Platform

Urlaub auf Krk d.o.o. provides only the technical infrastructure and advertising space. The owner bears full responsibility toward the guest. If a booking must be cancelled for reasons beyond the control of Urlaub auf Krk d.o.o. or due to the owner, Urlaub auf Krk d.o.o. will refund the paid amount on behalf of the owner but is not liable for further compensation.

12. Personal Data and Documents

All information and documents will be treated as business secrets in accordance with Croatian regulations and the GDPR. Urlaub auf Krk d.o.o. is not liable for the data protection measures taken independently by the owner/host.

13. Force Majeure and Extraordinary Events

If the use of the accommodation is prevented by force majeure (fire, flood, earthquake, war, pandemic, etc.) or extraordinary events (broken pipes, power failure), the owner/Urlaub auf Krk d.o.o. is entitled to terminate the contract. Payments will be refunded proportionally for the unused nights. No further liability is accepted.

14. Submission of Complaints
